This Agreement shall be construed in accordance with, and governed by, the Spanish laws as applied to contracts that are executed and performed entirely in Spain. The exclusive venue for any arbitration or court proceeding based on or arising out of this Agreement shall be Barcelona, Catalonia.
The Barcelona-Y-Daytrips reserves the right not to confirm the booking until the full amount set out in the invoice received by the client is paid and has been received by the Barcelona-Y-Daytrips and all the relevant information has been provided fully by the client.
Any amendments to, or cancellation of the booking shall be subject to these terms and conditions.
The tour and daytrips price includes only those services/items that are included as per the itinerary and the day trip booking confirmation, and the client shall be responsible and pay for any additional items when is required .
Any date change request must be initiated by e-mail, and should be acknowledged by Barcelona-Y-Daytrips.com. Notifications by phone will not be accepted.
Barcelona-Y-Daytrips date change policy is depend on when the change request being received at Barcelona-Y-Daytrips email address. If we receive client change request :
Up to 7 days before tour date:
Any cancelation could be done through the “Manage Booking” Link Provided in booking confirmation email or could be initiated by e-mail, and should be also acknowledged by Barcelona-Y-Daytrips.com via e-mail. Cancellation notifications by phone will not be accepted. In any case our cancellation policy for all our bookings received from any source is as follow:
Fully Refundable due to International Travel Restrictions by COVID: In case of raising, any new travel restrictions due to COVID, Whole booking amount will be refunded through the same payment method used by the client to pay for the services. (2 to 3% online transaction fee may be applied for a refund-processing fee)
Fully Refundable due to COVID infection: if any of travelers infected by COVID, our customer can reduce the number of travelers and ask for refund for infected persons or they can ask to cancel the booking completely and asking for a full refund. the amount for infected person (or whole group if they request for cancelling the booking) will be refunded through the same payment method used by the client to pay for the services. In this case official signed positive PCR or Antigen test results in needed for issuing a refund. (2 to 3 % online transaction fee may be applied for a refund)
Fully Refundable due to sickness and Medical issue: if any of travelers has a sickness, medical issue (or not feeling well) and could not travel in follow to medical report by Doctors or Hospitals, our customer can reduce the number of travelers and ask for refund for infected persons or they can ask to cancel the booking completely and asking for a full refund. the amount for sick person (or whole group if they request for cancelling the booking) will be refunded through the same payment method used by the client to pay for the services. In this case, official signed medical report stating the inability of travelling is needed for issuing a refund. (2 to 3% online transaction fee may be applied for a refund)
Fully Refundable for any reason, only if cancellation request received in a more than 48 hours experience’s start time: Whole booking amount will be refunded through the same payment method used by the client to pay for the services. (2-3% online transaction fee may be applied for a refund)
In any other case which is not mentioned above, all of our booking are non-refundable (even partially) and especially If cancellation request received in a less than 48 hours to experience’s start time.
Circumstances beyond our control: Barcelona-Y-Daytrips.com is not liable for reduced/cancelled itineraries due to circumstances beyond our control such as flight delays, ships unable to dock for whatever reason or unscheduled closures of tourist sites. Therefore, adequate insurance is strongly advised.
No-shows: If the client hasn’t shown up at pick-up time, we’d consider it a no-show and no refund will be given. (Failure to change number of travelers up to 48 hours to experience’s start time, will consider as a no-show declaration).
Changing a number of travelers: the price per person, in all of our tours, is varied based on a number of travelers in each booking. In order to change the number of travelers, all of our clients must contact us up to 48 hours to experience’s start time by email or through “Manage Booking” Link provided in Booking Confirmation email. if being done by email, Then our clients will receive a reply including a new price per person (according to new number of travelers) and then the price difference will be refunded through the same payment method used by the client to pay for the services. ( failure to change number of travelers up to 48 hours to experience’s start time, will result in no-show declaration).
In the unlikely event that Barcelona-Y-Daytrips.com or their tour guides had to cancel a tour, we’ll always first try to agree to another timeframe that works for the client.
If we couldn’t agree on another time for the tour or we couldn’t provide a substitute, the refund based on mentioned conditions would be done within 10 working days.
Client is urged to acquire adequate insurance to cover personal illness, Trip Cancellation, Trip Interruption, Emergency Medical, Emergency Medical Transportation, Baggage Loss/Damage, Travel Accident Coverage and road accident coverage (including a full coverage on losses due to death, loss of limb(s) or sight as a result ), and other circumstances beyond Barcelona-Y-Daytrips.com’s control that might cause the tour to be cancelled or might cause any kind of damage to client . It is the client’s responsibility to ensure that he or she has such insurance in place (together with the required paperwork to prove such insurance) before embarking on the day trip and Barcelona-Y-DayTrips.com is not liable for any delay or irregularity of this nature, nor any expenses resulting from them.
The client shall be responsible for all baggage and personal effects brought by him or her on the Day trip, and the Barcelona-Y-Daytrips.com shall not be liable for any loss , theft or damage to such baggage or personal effects, howsoever arising.
Client is responsible for their own safety and their party’s. That includes crossing roads/streets, going up/down stairs or steps, wearing seatbelt inside vehicles… Barcelona-Y-Daytrips.com is not liable for any injury, damage, loss or accident incurred during the tour.
Food: In lunch and breakfast stops, client is responsible for telling the tour guide about any food allergies or intolerances they might suffer so we can help choosing your food. The client takes full responsibility for the food that he or she decides to eat, and Barcelona-Y-Daytrips.com will never be liable for any health issue resulting from the food/drinks eaten/drunk during a tour. No food or drink to be consumed inside vehicles except by permission of the driver.
Agree to be responsible for your own welfare and properties and accept any and all risks of delay , unanticipated events ,inconvenience , illness . injury , emotional trauma or death .
Acknowledge that you have voluntarily applied to participate in the tour designated on this application, and do so with the knowledge of the risks and dangers involved, including but not limited to:
You agree that under no circumstances shall Barcelona-Y-Daytrips be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the site or service. In no event shall Barcelona-Y-Daytrip.com’s cumulative liability to you exceed the total purchase price of the Service or Product you have purchased from Barcelona-Y-Daytrips.com, and if no purchase has been made by you Barcelona-Y-Daytrips.com’s cumulative Liability to you shall not exceed €100.
